Payment & Cancellation Policies
A 50% deposit is required at booking to secure your reservation. The remaining 50% balance is due 30 days before your arrival. Bookings made within 30 days of arrival require full payment at time of booking.
All payments are non-refundable. We understand that unexpected circumstances arise, and if you need to cancel, we will make a good-faith effort to re-rent your dates. If we successfully re-book your reservation, we will refund the amount received from the new booking, less a 25% administrative fee to cover rebooking costs and lost opportunities.

AGREEMENT TO TERMS
By proceeding with your reservation through any method (website booking, third-party platforms, direct payment via PayPal/bank transfer, or signing a rental agreement), you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions. Your payment constitutes full acceptance of these terms. By completing a booking or sending payment, you confirm that you are at least 25 years old and authorized to enter into this agreement on behalf of all guests. You acknowledge that you have been advised to seek your own legal counsel in reviewing this document.

1. PAYMENT & CANCELLATION
All bookings are subject to the Payment & Cancellation Policy stated at the time of booking. By completing your reservation, you acknowledge and agree to those payment terms. Your payment via any method constitutes a legally binding agreement to these Terms & Conditions, even without a signed rental agreement. Any violation of these terms allows Casa Sol y Luna to terminate your stay immediately with no refund.

2. OCCUPANCY & HOUSE RULES
Maximum Guests: 8 overnight guests (adults and children combined), unless special written permission is granted. The property is for use by named guests only. Subletting or transferring the rental is strictly prohibited. The property is not available for parties, weddings, receptions, or large events unless explicitly pre-approved by the owner.
Quiet Hours: 9:00 PM to 8:00 AM
No Smoking Indoors: All smoking must be conducted outdoors.
No Pets: Pets are not permitted without explicit written approval.
Security: Keep all doors and windows locked when leaving the property. Use the safes provided in each bedroom for valuables.

3. GUEST RESPONSIBILITIES & DAMAGES
Complete Liability: You are responsible for all damage to the property or its contents caused by you, your guests, or any visitors, including damage caused by third parties during your stay. Upon taking possession, you become custodian of everything in the property and are responsible for all items and conditions.
Reporting: Report all damages, malfunctions, or issues immediately to the property manager.
Lost or Stained Items: Replacement charges apply - Towels: $20 USD each, Sheets: $30 USD per set, Bedding/Comforters: $80 USD each.
Cleaning: Additional fees apply for cleaning beyond normal use.
Authorization: You authorize the owner to charge your deposit or payment method for any damages, missing items, or fees.

4. COMPREHENSIVE LIABILITY RELEASE
Legal Capacity: You confirm you have legal capacity to enter into binding contracts.
Assumption of All Risks: You acknowledge and accept all risks of using the property, including risks that could lead to injury, disability, or death. Specific hazards include: swimming pool and slippery surfaces, ocean swimming/waves/currents, balconies/stairs/elevated areas, tile floors (slippery when wet), local roads and sidewalks, Mexican laws and customs, wildlife/insects/tropical conditions, and weather events.
Personal Responsibility: You accept full responsibility for being aware of your environment and using caution.
COMPLETE RELEASE: YOU RELEASE Casa Sol y Luna, its owner (Mikael Nazarian), property managers, employees, and agents FROM ALL CRIMINAL AND CIVIL LIABILITY for any event, loss, damage, injury, or death during your stay. You are responsible for all guests and visitors during your stay, including minors under your guardianship.
Indemnification: You agree to indemnify Casa Sol y Luna from any claims, demands, or actions arising from your use of the property, including claims caused by negligence or failure to follow rules.
No Responsibility: The owner is not responsible for lost or stolen personal items, weather conditions, utility interruptions (power, water, internet, gas), road conditions, construction noise, internet speed, water shortages, insect presence, minor variations from photos, or acts of nature. Refunds during the rental period are at the sole discretion of the owner.
Property Unavailability: If the property becomes unavailable due to circumstances beyond our control (natural disasters, property damage, government restrictions), we will refund all payments and void this agreement. We are not responsible for consequential damages, travel expenses, or other costs.

5. PROPERTY ACCESS & MAINTENANCE
Property Access: The owner or property manager may access the property for repairs, inspections, or emergencies with reasonable notice when possible. We strive for perfection, but occasional issues may arise. Please report problems immediately. Minor changes to décor, furnishings, or amenities may occur without notice.

6. UTILITIES & LOCAL CONDITIONS
Included: Water, electricity, gas, WiFi, and pool heating are included in your rental rate.
WiFi: High-speed internet is provided. Service may be slower than home internet.
Water: The public water in Sayulita is not recommended for drinking. Purified drinking water is provided throughout your stay. Public water shortages are common, especially spring/summer. Backup storage tanks minimize disruptions.
Electricity: Power outages may occur during storms.
Gas: Houses use refillable gas tanks. If gas runs out, contact us immediately for refill or exchange.
Local Conditions: Many Sayulita roads are unpaved. Construction near the property may occur. Tropical insects are common. Periodic pest control is performed.

7. PROHIBITED ACTIVITIES
No unlawful activities, illegal behavior, or commercial activities are permitted. The property is for residential vacation use only.

8. LONG-TERM STAYS (30+ DAYS)
Stays of 30+ days are temporary vacation rentals and do not create tenant rights under Mexican law. Rent must be paid in full before each rental month. Late payment may result in termination without refund. Long-term stays may require a refundable security deposit, returned within 14 days after checkout less any damage deductions.

9. LEGAL TERMS
Governing Law: This Agreement is governed by the laws of the State of Nayarit, Mexico.
Exclusive Jurisdiction: Any disputes must be resolved in the courts of Nayarit, Mexico. Both parties waive any right to jurisdiction in any other location, including US or Canadian courts.
Attorney Fees: You agree to pay all legal fees incurred by the owner in enforcing this agreement.
Severability: If any section of this agreement is found unenforceable, the remaining terms remain valid. This agreement is binding upon your heirs, representatives, and assigns.
Modifications: Changes to your reservation must be requested in writing and are subject to availability and approval.

10. ENTIRE AGREEMENT
This document, along with your booking confirmation, constitutes the entire agreement between you and Casa Sol y Luna. The person booking must be at least 25 years old and is responsible for all guests and visitors. YOU HAVE CAREFULLY READ THIS ENTIRE DOCUMENT, UNDERSTAND ITS CONTENTS, AND AGREE TO IT OF YOUR OWN FREE WILL WITH FULL KNOWLEDGE OF ITS LEGAL SIGNIFICANCE.
